These Terms and Conditions of Use (“Terms”) govern access to and use of the website www.hotdoogy.com, mobile application (“App”), and all other digital platforms operated by Hot Doogy Franchising Corporation (“Hot Doogy,” “we,” “our,” or “us”), including online ordering channels, delivery services, loyalty programs, and text messaging communications (collectively, the “Services”).

By accessing or using our Services, you (“User” or “Customer”) agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms
Your use of Hot Doogy Services is subject to your full acceptance of these Terms and our Privacy Policy, available at www.hotdoogy.com/privacy.
We reserve the right to modify these Terms at any time. Material changes will be posted and become effective immediately upon publication. Continued use of the Services after such updates constitutes your acceptance of the revised Terms.

2. Eligibility
You must be at least 13 years old to use our Services.
If you are under 18, your use is permitted only under the supervision of a parent or legal guardian.
By using our Services, you represent that you have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features (such as online ordering, loyalty programs, or promotions), you may be required to create an account by providing accurate, complete, and up-to-date information.

By placing an order, you agree that:

Orders cannot be canceled once preparation has begun, except where allowed by the store’s local policy.
Hot Doogy reserves the right to refuse or cancel any order in cases of suspected fraud, pricing errors, or product unavailability.
6. Promotions and Loyalty Programs
Hot Doogy may offer loyalty programs, coupons, discounts, and seasonal promotions.
Such offers may be subject to specific rules, validity periods, and user limits.
We reserve the right to modify, suspend, or terminate any promotion at any time without prior notice.
7. Intellectual Property
All content available on our Services—including text, logos, images, menus, illustrations, videos, designs, and source code—is the exclusive property of Hot Doogy Franchising Corporation or its licensors and is protected under applicable copyright, trademark, and intellectual property laws.
No content may be copied, reproduced, or used without prior written authorization.
8. Limitation of Liability
Hot Doogy strives to keep its Services available and secure but does not guarantee continuous, uninterrupted, or error-free access.
To the fullest extent permitted by law, Hot Doogy shall not be liable for:

Failures caused by third parties such as payment processors, delivery apps, or internet providers;

External content or links that may appear within our platforms.
In any case, Hot Doogy’s total liability shall not exceed the amount paid by the Customer for the product or service in question.

The collection and processing of Users’ and Customers’ personal data are governed by the Hot Doogy Privacy Policy, available at www.hotdoogy.com/privacy.
By using our Services, you acknowledge and agree to the practices described in that Policy.
10. Text Messaging Program Terms & Conditions (USA)

These Terms apply only if you have opted in to a text messaging program operated by Hot Doogy Franchising Corporation (“Hot Doogy”) and may include both Short Message Service (SMS) and Multimedia Message Service (MMS) functionality.
By opting in to Hot Doogy’s text messaging program, you understand and agree that these Terms and Conditions for Hot Doogy Online Services (USA) are incorporated into, and form part of, the Hot Doogy Text Messaging Program Terms & Conditions.
You acknowledge that the program is considered an “online service” under these Terms.
1. About the Program
This is a standard-rate text messaging program.
By subscribing, you consent to receive automated marketing text messages at the mobile number you provided from or on behalf of Hot Doogy (and its agents or service providers) through the short code or number provided within the campaign.
Your consent is not a condition of purchase for any goods or services.
Hot Doogy’s Privacy Policy explains how we collect, use, and share information.
2. Charges and Fees
Hot Doogy does not charge for its text messaging program; however, your mobile carrier’s message and data rates may apply.
Message frequency may vary.
To participate, you must have a text-enabled mobile device with an active text messaging plan.
Please contact your mobile carrier for information about your text messaging plan and applicable charges.

3. Franchisee Messaging Programs
Some Hot Doogy restaurants are independently owned and operated by franchisees.
These Terms do not apply to text marketing programs managed directly by franchisees.
If you are receiving messages from a Hot Doogy franchisee, you must opt out directly with them.
Each franchisee is solely responsible for its own legal and regulatory compliance.
4. How to Use the Messaging Service

For Help: Text “HELP” to the Hot Doogy number you opted in to for program assistance at any time.

How to Opt-In: To subscribe, text the keyword(s) provided in the campaign to the number indicated.

How to Opt-Out: To stop receiving text messages, text “STOP” to the Hot Doogy number you opted in to.
Opting out of one communication channel (e.g., SMS) does not automatically unsubscribe you from others (e.g., email).
11. Termination of Access
Hot Doogy reserves the right to suspend, restrict, or terminate any User’s access to the Services for violating these Terms, without prior notice or compensation.
12. Changes to the Services
We may modify, update, or discontinue any part of our Services, features, menus, or pricing at any time, without prior notice.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Massachusetts (USA).
In the event of a dispute, both parties agree to submit to the exclusive jurisdiction of the courts located in Boston, MA, waiving any right to claim otherwise.
